Understanding real estate and mortgage law is essential for lawyers practicing in commercial, taxation, litigation, estates, and family law. This graduate course studies the manner in which interests in land are bought, sold, and mortgaged. Students will learn about the legal and economic issues in real estate transactions as well as the legal principles available for dealing with them. Problems related to real estate transactions, including those involving real estate agents, vendor and purchaser, the agreement of purchase and sale, mortgagor and mortgagees and solicitors duties will be examined. Remedies available to the parties when the transaction is not completed, including damages and specific performances, are also examined. The course will focus on standard residential purchase and sale transaction, but will consider commercial real estate transactions as appropriate. The course will also address current legal issues and the role of the lawyer including the lawyer’s obligations and ethical considerations.
