Is your construction arbitration process working? – or just expensive?
New for Canada’s construction arbitration community: an innovative national program for experienced dispute professionals focused on streamlining process design, managing evidence effectively, and improving cost and timing outcomes across the full arbitration lifecycle–from front-end design and early case management through evidence planning, hearing strategy, and final submissions. Includes an optional, hands-on workshop for those seeking tribunal-facing practice and feedback.
In complex, multi-party and expert-driven disputes, outcomes often turn on a handful of early choices: how the process is structured, how issues are narrowed, and how the record is built for decision-making. The first day focuses on tribunal-informed best practices and the operating moves that prevent procedural drag and credibility loss. The optional workshop day turns those concepts into structured performance practice through realistic mock hearings, guided by direct decision-maker feedback.
Can’t Make the Date? Registration includes 120-day unlimited, online access to the recorded program (please note: the October 15 workshop will be live only.)
What You’ll Learn
Strategies to set up a first procedural conference that narrows issues early and maintains momentum
Best practices for drafting fit-for-purpose construction dispute resolution clauses
Methods for applying proportionality tools that tribunals actually use in practice (limits, staging, disciplined issues lists)
Insights for building a focused and efficient disclosure plan for high‑volume project records
Tips for framing Redfern requests and responses so they are clear, proportionate, and practical to rule on
How to craft PO‑1 core terms that control pace, scope, and fairness
Effective approaches for managing privilege efficiently and transparently within the process
Tools to address non‑party evidence hurdles (authority, access, subpoenas)
Techniques for presenting delay/quantum and other expert‑driven issues with clarity and credibility
How to package a decision‑ready record: issues map, chronology, Scott schedule structure, and a clear path to decision
Tactics for navigating interim motions and urgent relief without derailing the timetable
PLUS! Optional Day 2 Workshop: includes live mock hearings with direct tribunal feedback (breakouts will be live only; not recorded), and a capstone session Inside the Decision Room with tribunal-informed insights and best practices.
