Litigating estate matters require both the ability to expertly navigate the estate litigation process and a thorough understanding of this specific area of law. How confident are you in your skills?
Over three evenings, this OsgoodePD practical and intensive course, will discuss the fundamentals of estate litigation, and give you the tools to confidently advise your client and be an effective advocate in estate matters.
From the essential considerations at your initial client meeting to the evidence involved in contentious proceedings, our expert faculty will walk you through the steps that you would need to successfully advocate on behalf of your client.
Registration includes 120-day unlimited, online access to the recorded program.
What You’ll learn
Evaluate information to be obtained at the first client meeting
Deal with the legal issues involved in a will challenge
Analyze duties related to dealing with those who may have diminished capacity
Make the most out of the opportunity to mediate an estate dispute
Identify limitation periods that you need to keep in mind
Obtain the latest case law updates on the issue of costs and unjust enrichment
Explain to your client the various applications, motions, and orders in the estate litigation process
Appropriately object to Certificate of Appointments
Argue claims against the Estate pursuant to the Estates Act
Understand the evidence involved in contentious proceedings
Learn your obligations and the steps in locating missing beneficiaries
